Meeting called to order by Chairman Wiese at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Fischbach, Feickert and Knecht.

SET HEARING DATE:
Moved by Hansen, seconded by Knecht to set public hearing for 5:30 p.m. on March 24, 2008 in the Aberdeen City Council Chambers, 123 S Lincoln Street for First Reading of the following: Ordinance No. 08-03-01/361, An Ordinance to rezone the following property from Section 701 (A-1) Agricultural District to Section 714 (M-AG) Mini-Agricultural District: Lot 7, Block 1, Richmond Heights Subdivision in the SE ¼ of Sec 32-T124N-R64W of the 5th P.M., Brown County, SD. All members present voting aye. Motion carried.
SHERIFF REPORTS:
Moved by Hansen, seconded by Knecht to approve the following January 2008 Sheriff Reports: Incidents and Offenses, Prisoner Care, JDC, Money deposited with the County Treasurer and Monthly activities. All members present voting aye. Motion carried.
NOXIOUS WEED NOTICE:
Moved by Feickert, seconded by Knecht to authorize advertising the 2008 Noxious Weed Notice. All members present voting aye. Motion carried.
MALT BEVERAGE LICENSE HEARING:
Time and place, as advertised for public hearing to consider application, submitted by Aberdeen Hockey Association for an annual Retail (on-off sale) Malt Beverage License. Moved by Hansen, seconded by Knecht to approve the following application for a Retail (On-Off Sale) Malt Beverage License, effective until June 30, 2008: Retail (on-off sale) Malt Beverage License: Aberdeen Hockey Association, Inc., PO Box 515 Aberdeen, SD – Brown County Fairgrounds SW ¼ of Sec 1-T123N-R64W of the 5th P.M. (Odde Hockey Building – map indicating specific building on file with application). All members present voting aye. Motion carried.
EQUIPMENT RENTAL SPACE AT FAIRGROUNDS:
Kurt Smith, Fairgrounds Manager returned for further discussion and decision in regard to request from Scott Madsen to rent year around storage space at the Fairgrounds for private business equipment. The Commission denied the request, as the Fairgrounds would not be able to accommodate similar year around storage space rental requests from the public in addition to the current established winter rental of the various buildings for storage.
SAFETY COMMITTEE REPORT:
Safety Committee members Lisa Samson, Scott Meints and Judy Dosch presented information on the Employee Health Fair to be held from 10 a.m. to 2 p.m. on March 20, 2008 requesting Commission support. The members also discussed several ice related accidents, which occurred last month; and outlined procedure for employee safety training in the future. The Commission thanked the members for their efforts with the Health Fair and will encourage all employees to attend.
LOAD LIMIT RESOLUTION:
Commissioner Knecht offered the following Resolution:
RESOLUTION NO. 23-08
WHEREAS: Enforce Annual Seasonal Load Restrictions on over weight limits, over width load limits, and speed limits on Brown County Roads. All Brown County oil Roads are posted at 6-ton per axle and truck speed of 40 MPH, with the exception of Brown County Road #10, from Brown County Road #13 (Prairiewood Road) north 10.0 miles to Brown County Road #9 is posted at 12-ton gross load limit with truck speed at 40 MPH year round.
WHEREAS: The Brown County Board of Commissioners request that the South Dakota Highway Patrol assist and enforce load restrictions on the posted gross limit per axle and truck speed at 40 MPH as posted by the Brown County Board of Commissioners during the March/April spring thaw and breakup period that the roads are posted.
THEREFORE BE IT RESOLVED: That the Brown County Board of Commissioners authorize the Brown County Highway Department Superintendent to work with the South Dakota Highway
Patrol to reduce weight maximums due to the thawing and excessive moisture and until the roads are free of frost and become stable. SDCL 32-22-25

SEASONAL LOAD RESTRICTIONS:
Moved by Feickert, seconded by Hansen to approve the following seasonal load restrictions for 2008: The Brown County Highway Department seasonal load restrictions will go into effect Wednesday, March 12, 2008, or when the load limit signs are installed and displayed, on all Brown County Oil Roads, except the Belt Loop around Aberdeen and other specified roads that are listed below. All Asphalt Roads will be posted at 6-tons per axle and 40 MPH for trucks during the March/April spring thaw and breakup or until roads become stable. No overweight or overwidth permits will be issued except in extreme cases of emergency. If such an emergency exists, the following permit fees will be applicable:
Single Permit - $10.00
Temporary Permit - $20.00
Annual Permit - $50.00

Moved by Knecht, seconded by Fischbach to authorize advertising Brown County Surplus Sale to be held at the Brown County Highway Department on April 18, 2008. All members present voting aye. Motion carried.
CONTRACTS:
Moved by Feickert, seconded by Hansen to authorize the Chairman sign contracts for material, supplies and rental of equipment bid for the Highway Department. All members present voting aye. Motion carried.
TEEN COURT JABG FUNDING:
Bonnie Siebrecht, Teen Court read a prepared statement in regard to difficulty working with the Auditor on the Juvenile Accountability Block Grant.
Moved by Hansen, seconded by Feickert to approve hiring Bonnie Siebrecht at $10.00 per hour, retroactively to November 1, 2007, as that was the wage stated in the Juvenile Accountability Block Grant application for Teen Court. All members present voting aye. Motion carried.
CENTENNIAL VILLAGE ANNUAL REPORT:
Don Gisi presented the 2007 Centennial Village Annual Report.
PHASE II JAIL PROJECT UPDATE:
Mick Palmer, Tom Schmitt and Mark Milbrandt discussed areas of the Phase II Jail Project that are not complete. Dean Markse said the target date for completion is Friday, March 7, however, the floor must cure for seven days after all painting is complete and the elevator will take longer.
EXECUTIVE SESSION:
Moved by Fischbach, seconded by Knecht to go into executive session for personnel discussion. All members present voting aye. Motion carried.
The Chairman declared the executive session closed, with the following action taken as a result of the discussion.
2008 SALARY SCHEDULE AMENDED:
Moved by Fischbach, seconded by Hansen to amend the 2008 Salary Schedule, as follows, to be effective March 9, 2008:
1) Change heading from Planning/Zoning and Appraisers/Computer Support Specialist category to read Appraisers.
2) Establish new category Computer/Technology Support Specialist:

EMPLOYEE STATUS CHANGE:
Moved by Fischbach, seconded by Hansen to approve employee status change for Chris Stucke from Step 5 in former category ($15.80 per hour) to Step 3 in new Computer/Technology Support Specialist category at $17.35 per hour, effective March 9, 2008. All members present voting aye. Motion carried.

The Chairman declared the Commission recessed until March 11, 2008.
