JANUARY 29, 2008 GENERAL MEETING
Meeting called to order by Chairman Wiese at 8:45 A.M. in the Commissioner’s
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Fischbach, Feickert and Knecht.

Move by Knecht, seconded by Hansen to approve the General Meeting minutes of

PLANNING & ZONING APPOINTMENT:
Moved by Hansen, seconded by Feickert to appoint Patrick Keatts to First Term on
the Brown County Planning and Zoning Board, effective January 1, 2008 – December
31, 2012. All members present voting aye. Motion carried.
LEASE AGREEMENTS:
Moved by Hansen, seconded by Fischbach to approve and authorize the Chairman
sign the following Lease Agreements: Tract 1 – SW ¼ of Sec 30 and NW ¼ of Sec
31-T128N-R65W (254 acres more or less) to L.R. Corporation for $14.50 per acre
($3,683.00). Tract 2 – SW ¼ of NW ¼, W ½ of SW ¼ and SE ¼ of SW ¼ of Sec
20-T128N-R65W (142 acres more or less) to Thorpe Ranch for $14.50 per acre
($2,059.00), effective February 1, 2008 to October 1, 2008, with no option to
renew this lease after October 1, 2008 with Brown County or to purchase through
this lease. All members present voting aye. Motion carried.
LANDFILL PERMIT RENEWAL DOCUMENTATION:
Moved by Fischbach, seconded by Feickert to approve and authorize the Chairman
sign the following documents for the Brown County Landfill Permit Renewal:
Application for Department of the Army Permit (west quarter Landfill expansion);
SD DENR renewal application to operate a solid waste disposal facility
(landfill); Air Quality Permit application form Title V (Part 70) operating
permit, general information form and certification of applicant form. All
members present voting aye. Motion carried.
SHERIFF REPORTS:
Moved by Hansen, seconded by Fischbach to approve the following December 2007
Sheriff Reports: Incidents and offenses, Prisoner care, JDC, Money deposited
with the County Treasurer and Monthly activities. All members present voting
aye. Motion carried.
PDM MATCH:
Moved by Feickert, seconded by Knecht to approve and authorize the Chairman to
sign letter of commitment to meet the matching fund requirements for the FEMA
PDM-C Pre-Disaster Mitigation Plan Project in amount of $4,333.00. All members
present voting aye. Motion carried.
CITIZENS CORP GRANT AGREEMENT:
Moved by Hansen, seconded by Knecht to approve and authorize the Chairman sign
Citizens Corps Grant Agreement with the SD Office of Emergency Management. All
members present voting aye. Motion carried.
ORDINANCE NO. 046:
Moved by Hansen, seconded by Fischbach to approve Second Reading and Adoption of
Ordinance No. 046, An Ordinance amending Second Revision Brown County Ordinances
to rezone the following described property from its present zoning designation
of Chapter 4.10 Lake Front Residential District (R-3) and Chapter 4.06
Agriculture Preservation District (AG-P) to Chapter 4.10 Lake Front Residential
District (R-3): Keatts Fifth Subdivision in the W ½ of the NW ¼ of Sec
23-T124N-R65W of the 5th P.M., Brown County, SD. Roll call vote: Commissioners
Hansen-aye, Fischbach-aye, Feickert-aye, Knecht-aye, Wiese-aye. Ordinance
adopted.
ORDINANCE NO. 047:
Moved by Feickert, seconded by Hansen to continue public hearing for Second
Reading of Ordinance No. 047, An Ordinance amending Second Revision Brown County
Ordinances to rezone the following described property from its present zoning
designation of Chapter 4.06 Agriculture Preservation District (AG-P) to Chapter
4.11 Rural Urban District (RU): Replat of Miller’s Outlot F in the SE ¼ of Sec
24-T124N-R65W of the 5th P.M., Brown County, SD until February 12, 2008 at 8:45
a.m. All members present voting aye. Motion carried.
ORDINANCE NO. 048:
Moved by Hansen, seconded by Feickert to approve Second Reading and Adoption of
Ordinance No. 048, An Ordinance amending Second Revision Brown County Ordinances
to rezone the following described property from its present zoning designation
of Chapter 4.06 Agriculture Preservation District (AG-P) to Chapter 4.07 Mini-Ag
District (M-Ag): Legacy Development in the NE ¼ of Sec 1-T123N-R65W of the 5th

ORDINANCE NO. 049:

Ordinance No. 049, An Ordinance amending Second Revision Brown County Ordinances

ORDINANCE NO. 050 – FIRST READING:
Moved by Knecht, seconded by Hansen to approve First Reading of Ordinance No.
050, An Ordinance amending Second Revision Brown County Ordinances, Title 4,
specifically Chapter 4.01 Definitions and Chapter 4.19 Floodplain District (FP)
regarding the new flood insurance rate map and flood insurance study that will
become effective on March 18, 2008. All members present voting aye. Motion
carried.
APPLICATION FOR OCCUPANCY:
Moved by Fischbach, seconded by Knecht to approve application, submitted by
NorthWestern Energy for occupancy of Brown County Highway #14 in Sec
16-T123N-R63W, Brown County, SD to install natural gas pipeline. All members
present voting aye. Motion carried.
BID AWARD - CULVERTS:
Moved by Knecht, seconded by Hansen to award low bid, submitted by Huron Culvert
& Tank Company for furnishing and delivery of metal culverts and bridge
material, as bid by Beadle County on January 8, 2008; rejecting bid submitted by
Central Culvert Supply (full tabulation sheet available for public inspection at
Auditor’s Office). All members present voting aye. Motion carried.
HIGHWAY UPDATE:
Richard Burns, Interim Highway Superintendent recommended proceeding with the
following bridge projects: Bridge #51 80/20 match of estimated cost @
$865,000.00, Bridge #31 80/20 match of estimated cost @ $411,000.00, to be bid
by the SDDOT. Board concurred. Inquiry received from Don Widstrom, Liberty
Township about options for obtaining gravel for township roads was referred to
the Highway Department.
RICHMOND LAKE DAM STUDY:
The Commission discussed the request from the Office of the SD Commissioner of
School and Public Lands for cost share funding for Richmond Lake Dam study. Gary
Vetter, Scott Meints and Mary Clawson were also present for the discussion. A
telephone conference with all interested parties will be held later.
RECESS:
The Chairman declared the Commission recessed until February 5, 2008.
