FEBRUARY 12, 2008 – GENERAL MEETING
Meeting called to order by the Chairman Wiese at 8:45 A.M. in the Commissioner’s
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Fischbach and Feickert. Absent Commissioner Knecht.
MINUTES:
Moved by Fischbach, seconded by Feickert to approve the Joint City/County
meeting minutes of February 4, 2008 and the General Meeting minutes of February
5, 2008. All members present voting aye. Motion carried.

PERSONNEL:
Moved by Feickert, seconded by Fischbach to approve employee status change for
Dawn Reiners and Amber Crouch from part-time employee to permanent part-time
employees in the jail, effective February 10, 2008 at $10.07 per hour. All
members present voting aye. Motion carried.
Moved by Feickert, seconded by Fischbach to acknowledge resignation of Ross
Erickson and Kyle Fadness from the Sheriff Department, effective February 25,
2008. All members present voting aye. Motion carried.
Moved by Fischbach, seconded by Feickert to approve hiring Joseph Embery,
effective March 3, 2008 and Charles Tveit and Timothy Harford, effective
February 19, 2008 as full-time correction officers in the Jail at $12.03 per
hour. All members present voting aye. Motion carried.
MALT BEVERAGE HEARING SET:
Moved by Fischbach, seconded by Feickert to authorize advertising public hearing
to consider the following application for a Retail (On-Off Sale) Malt Beverage
License, to be held in the Brown County Commission Chambers, Courthouse Annex at
8:45 a.m. on March 4, 2008: Retail (on-off sale) Malt Beverage License: Aberdeen
Hockey Association, Inc., PO Box 515 Aberdeen, SD – Brown County Fairgrounds SW
¼ of Sec 1-T123N-R64W of the 5th P.M. (Odde Hockey Building – map indicating
specific building on file with application). All members present voting aye.
Motion carried.
PLATS:
Commissioner Feickert offered the following Resolution:
RESOLUTION NO. 15-08
BE IT RESOLVED by the Board of County Commissioners of Brown County, SD, that
the plat showing “Kolb Subdivision in the NE ¼ of Sec 4-T125N-R64W of the 5th
P.M., Brown County, SD”, having been examined, is hereby approved in accordance
with the provisions of SDCL 11-3, and any amendments thereof.
Seconded by Commissioner Hansen. Roll call vote: Commissioners Hansen-aye,
Fischbach-aye, Feickert-aye, Knecht-absent, Wiese-aye. Resolution adopted.
Commissioner Feickert offered the following Resolution:

BE IT RESOLVED by the Board of County Commissioners of Brown County, SD, that
the plat showing “Didreckson Subdivision in the NW ¼ of Sec 26-T123N-R65W of the
5th P.M., Brown County, SD”, having been examined, is hereby approved in
accordance with the provisions of SDCL 11-3, and any amendments thereof.
Seconded by Commissioner Hansen. Roll call vote: Commissioners Hansen-aye,
Fischbach-aye, Feickert-aye, Knecht-absent, Wiese-aye. Resolution adopted.
Commissioner Feickert offered the following Resolution:
RESOLUTION NO. 17-08
BE IT RESOLVED by the County Commission of Brown County, SD, that the plat
showing “WEB Water Lot 1 in SW ¼ Sec 35-T122N-R60W of 5th P.M., Brown County,
SD”, having been examined, is hereby approved in accordance with the provisions
of SDCL of 1967, Chapter 11-3, and any amendments thereof.
Seconded by Commissioner Hansen. Roll call vote: Commissioners Hansen-aye,
Fischbach-aye, Feickert-aye, Knecht-absent, Wiese-aye. Resolution adopted.
ORDINANCE NO. 047:
Time and place for second reading and possible adoption of Ordinance No. 047.
Attorney Gerald McNeary and Attorney Rory King presented testimony against
adoption of the ordinance. After discussion the following action ensued: Moved
by Feickert, seconded by Fischbach to deny adoption of Ordinance No. 047, An
Ordinance amending Second Revision Brown County Ordinances to rezone the
following described property from its present zoning designation of Chapter 4.06
Agriculture Preservation District (AG-P) to Chapter 4.11 Rural Urban District
(RU): Replat of Miller’s Outlot F in the SE ¼ of Sec 24-T124N-R65W of the 5th
P.M., Brown County, SD. Roll call vote: Commissioners Hansen-aye, Fischbach-aye,
Feickert-aye, Knecht-absent, Wiese-aye. Ordinance denied.
LEASE DISCUSSION:
States Attorney Kim Dorsett and Fairgrounds Manager Kurt Smith discussed lease
addendum for house at Richmond Lake to increase deposit amount. Board concurred.
EXECUTIVE SESSION:
Moved by Hansen, seconded by Feickert to go into executive session for personnel
discussion with Richard Burns and Mark Wendt in attendance. All members present
voting aye. Motion carried.
The Chairman declared the executive session closed, with the following action
taken as a result of the discussion.
Moved by Feickert, seconded by Hansen to authorize Interim Highway
Superintendent Richard Burns establish a personal cell phone use policy for the
Highway Department. All members present voting aye. Motion carried.
BUILDING PERMIT FEE SCHEDULE:
David Heyd and Joel Durheim met to request the penalty for not obtaining a
building permit be waived or lowered. The Commission will take under advisement.
RECESS:
The Chairman declared the Commission recessed until February 19, 2008.
