TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:
The purpose of this notice is to identify two separate but related actions to be taken by the Town of Hecla.
On or about August 25, 2009 the above-named Town of Hecla will request the Governor’s Office of Economic Development (GOED) to release Federal funds under Title I of the Housing and Community Development Act of 1974 as amended (PL 97-35) for the following project:
Sewer Line Repairs Project

To replace 1,425 linear feet of sanitary 8” sanitary sewer line and 220 linear feet of 4” sanitary sewer line.

It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above-named City has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).
The reasons for such decision not to prepare such Statement are as follows:
The appropriate Federal and State agencies have been contacted for their comments regarding the environmental impacts of this project. Their comments stated that the above-mentioned project would not adversely impact the environment.
An Environmental Review Record of the project has been made by the Town of Hecla, which documents the environmental review of the project, and more fully sets forth the reasons why such Statement is not required. This Environmental Review Record is on file at Town of Hecla and is available for public examination and copying upon request at the Hecla City Hall between the hours of 8 a.m. and 5 p.m. No further Environmental Review of this project is proposed prior to the request for release of Federal funds.
All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for consideration by the Town of Hecla to the office of the undersigned. Comments should specify which notice, Finding of No Significant Impact, or Intent to Request Release of Funds, is being addressed. Such written comments will be received at the address specified on or before August 25, 2009.
All comments received will be considered and the Town of Hecla will not request the release of Federal funds or take any administrative action on the project prior to the date specified in the preceding sentence.
The Town of Hecla will undertake the project described herein with Community Development Block Grant funds from the Governor’s Office of Economic Development under Title I of the Housing and Community Development Act of 1974. The Town of Hecla is certifying to the Governor’s Office of Economic Development that the Town of Hecla and Chief Executive Officer or other Certifying Officer approved by the Governor’s Office of Economic Development in her/his official capacity as Project Environmental Officer consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision-making and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval the Town of Hecla may use the Block Grant funds and the State and HUD will have satisfied their responsibilities under the National Environmental Policy Act of 1969.
The Town of Hecla was also awarded a $143,390 Clean Water State Revolving Fund loan with 10 percent of that amount in principal forgiveness through the American Recovery and Reinvestment Act of 2009. If the requirements of the American Recovery and Reinvestment Act of 2009 are not met and the Town of Hecla proceeds with funding the project with an SRF loan, the 10% principal forgiveness will revert to a rate and term which will be established at that time. The SRF loan portion which is not principally forgiven will be $129,051 at a rate of 3% and a term of 20 years.
The Governor’s Office of Economic Development will accept an objection to its approval only if it is on one of the following basis: (a) that the certification was not in fact executed by the environmental certifying officer or other officer of applicant approved by the GOED, or (b) that applicant’s environmental review record for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process. Objections may be addressed to the Department of Tourism and State Development, Governor’s Office of Economic Development, Community Development Block Grant Program, 711 E. Wells Avenue, Pierre, South Dakota 57501-3369.
Objections to the release of funds on basis other than those stated above will not be considered by the GOED. No objection received after, September 9, 2009 will be considered by the State.
