LEASE AGREEMENT:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign the following agreement: RDO for lease of the Holum Expo Building on September 8 & 9, 2009. All members present voting aye. Motion carried.
LANDFILL EXPANSION PROJECTS:
Moved by Wiese, seconded by Elliott to approve and authorize the Chairman sign Payment Request #10 in amount of $86,520.80 for the Landfill Expansion Project. All members present voting aye. Motion carried.
Moved by Wiese, seconded by Elliott to approve and authorize the Chairman sign Payment Request #1 in amount of $88,409.17 for the Brown County Landfill Expansion Fencing Project. All members present voting aye. Motion carried.
GRANT AWARD – HIGHWAY SAFETY:
Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign Highway Safety Grant Award for funding in amount of $29,340.00. All members present voting aye. Motion carried.
TEEN COURT JABG APPLICATION:
Moved by Hansen, seconded by Wiese to approve and authorize the Chairman sign application for Department of Corrections – Juvenile Accountability Block Grant in amount of $12,777.78 (90% DOC, 10% County), effective October 1, 2009 – September 30, 2010. All members present voting aye. Motion carried.
POOR RELIEF LIEN:
Commissioner Sutton offered the following Resolution:
RESOLUTION NO. 55-09
WHEREAS, Brown County has filed a Poor Relief Lien in total amount of $8,602.28 with a balance of $6,502.28, and
WHEREAS, Brown County has determined it to be in the best interest of the taxpayers to release certain property from the effect of said lien, upon condition that the lien remain filed against the individuals and remaining property owned.
NOW, THEREFORE BE IT RESOLVED that the following real property, which is described as follows:
Lot 4 in Block 34 of the Subdivision entitled “N ½ of Block 11, S ½ of Blocks 17,18,19 and 20, Blocks 27 to 34 inclusive Outlots F to L inclusive, to Hecla, Brown County, South Dakota
is hereby released from the effect and force of said lien, upon condition that the lien shall stay filed against the individuals.

PROPERTY CONVEYANCE:
Commissioner Sutton offered the following Resolution:
RESOLUTION NO. 56-09
WHEREAS, Brown County is the legal owner of a Certificate of Tax Sale, which was conveyed to Brown County by Treasurer’s Tax Deed and duly recorded in the Register of Deeds office on March 11, 2009 in Book 288 Page 796, and
WHEREAS, there are trees on the property that need to be taken down and the house is in a very dilapidated condition and also needs to be removed, and
WHEREAS, the Hecla City Council has requested the County remove existing poor relief liens and deed the property to the City of Hecla in exchange for the tree and house removal.
NOW THEREFORE, BE IT RESOLVED, that the Brown County Commission declare the following property surplus and execute a Quit Claim Deed conveying the property to the City of Hecla: Lot 4 in Block 34 of the Subdivision entitled “N ½ of Block 11, S ½ of Blocks 17,18,19 and 20, Blocks 27 to 34 inclusive Outlots F to L inclusive, to Hecla, Brown County, South Dakota

TAX DEED SALE:
Moved by Sutton, seconded by Wiese to authorize advertising the following described property to be offered for sale by auction in the Community Room, Brown County Courthouse Annex, on October 5, 2009 at 10:00 a.m., and further to declare property surplus for purpose of sale (90% of minimum bid):
Aberdeen Twp: The N 333’ of the 900’ West of the East 1150’ of the NE ¼ of Sec 27-T123-R64W of the 5th P.M., Brown County, SD @ $16,000.00. All members present voting aye. Motion carried.
EXECUTIVE SESSION:
Moved by Wiese, seconded by Sutton to go into executive session for personnel discussion with Jan Weismantel and Kim Dorsett in attendance. All members present voting aye. Motion carried.

RAILROAD AVENUE PROPERTY LINES:
Gary Fischer and Mick Palmer presented certificate of survey that defines the position of the building at 117 RR Ave on the lot, as discussed on September 1, 2009. An easement will be drafted by the States Attorney to be approved at a later date.
