OCTOBER 13, 2009 – GENERAL MEETING
Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioner’s
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Elliott, Sutton and Wiese.
YEARS OF SERVICE AWARDS:
The Commission presented the following Certificates of Appreciation and

Moved by Elliott, seconded by Sutton to acknowledge resignation of Heather
Beusch as part-time 24/7 Sobriety employee, effective October 4, 2009. All
members present voting aye. Motion carried.
Moved by Wiese, seconded by Sutton to acknowledge the following miles driven and
amount to be taxed for personal use of County vehicles during the month of July
2009: Jan Weismantel – 81.6 @ $44.88, Markcus Selzler – 98 @ $53.90, Kendell
Titze – 66 @ $36.30, Mark Wendt 384 @ $211.20, Michael Scott – 210 @ $115.50.

HOLIDAY CLOSING:
Moved by Sutton, seconded by Hansen to close Friday, November 27th, with the
following policy: each employee will be compensated for eight hours regular pay
for the day, if an employee is required to work a full shift on November 27th,
eight hours will be added to their vacation record – under no circumstances will
premium pay be paid for these hours. All members present voting aye. Motion
carried.
DETERMINATION OF RIGHT-OF-WAY EASEMENT:
Moved by Wiese, seconded by Hansen to acknowledge receipt of letter withdrawing
the application, submitted by Prairie Hill Farms LLC for determination by the
Commission in accordance with SDCL 31-22-2 whether a right-of-way should be
granted to Prairie Hill Farms, LLC from landowners Dean Weismantel and Donald
Weismantel. All members present voting aye. Motion carried.
SHERIFF REPORTS:
Moved by Wiese, seconded by Sutton to approve the following September 2009
Sheriff Reports: Incident and offenses; Prisoner care, JDC, Money deposited with
the County Treasurer and Monthly activities. All members present voting aye.

LEASE AGREEMENT:
Moved by Wiese, seconded by Hansen to approve and authorize the Chairman sign
the following agreement: Brown County 4-H for lease of the Holum Expo Building
on October 4, 2009. All members present voting aye. Motion carried.
COURTHOUSE ROOF PROJECT CHANGE ORDER:
Moved by Sutton, seconded by Elliott to approve and authorize the Chairman sign
Change Order #1 with Grote Roofing Inc. for Courthouse Roof Project awarded June
30, 2009, extending completion date to December 31, 2009. All members present
voting aye. Motion carried.
APPLICATION FOR OCCUPANCY:
Moved by Elliott, seconded by Wiese to approve application, submitted by
Northern Electric for occupancy of intersection of 389th Ave and 130th Street in
Sec 5-T123N-R63W of the 5th P.M., Brown County, SD to install underground
trenching for light pole. All members present voting aye. Motion carried.
RACE TRACK OPTION:
Moved by Sutton, seconded by Elliott to approve and authorize the Chairman sign
request, submitted by Jamie Naasz for one-year option to lease Brown County
facilities at the Fairgrounds for the 2010 Car Racing season, per lease dated
November 25, 2008. All members present voting aye. Motion carried.
FAIR UPDATE:
Larry Gerlach, Fair Manager presented a recap of the 2009 Brown County Fair.
BREAK ROOM DISCUSSION:
Courthouse employees met with the Commission to discuss the use and storage of
individual appliances in the Employee break area, rather than in the EOC
kitchen. The Commission will visit area with the Maintenance Department.
RECESS:
The Chairman declared the Commission recessed until October 20, 2009.
