Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Elliott, Sutton and Wiese.

Moved by Hansen, seconded by Elliott to accept resignation of Kevin T. Spitzer, Brown County Coroner, effective November 3, 2009, due to recent move to Mina Lake, which is in Edmunds County. All members present voting aye. Motion carried.
LEASE AGREEMENT:
Moved by Elliott, seconded by Sutton to approve agreement with Sturgis SD Soccer Team for lease of the Richmond Lake Youth Camp Lodge on October 7 – 11, 2009. Roll call vote: Commissioners Hansen-aye, Elliott-aye, Sutton-aye, Wiese-nay, Fischbach-aye. Motion carried.
COMBINED ELECTION AGREEMENT:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign Agreement between Brown County, Aberdeen School District 6-1 and the City of Aberdeen for the purpose of conducting a combined election as provided under the provisions of SDCL 9-13-37, 13-7-10.3 and 12-2-5 on June 8, 2010. All members present voting aye. Motion carried.
FAIR CONTRACT:
Moved by Elliott, seconded by Sutton to acknowledge contract between Theatrical Media Services Inc and Brown County Fair Board to provide sound, lighting, stage roof and spotlights for the 2010 Brown County Fair. All members present voting aye. Motion carried.
JABG AWARD:
Moved by Hansen, seconded by Wiese to approve and authorize the Chairman to sign Notice of Award for Federal Fiscal Year 2006 (JABG) Juvenile Accountability Block Grant - Teen Court/Diversion Program Funding, effective October 1, 2008 – September 30, 2009 in amount of $12,007.00 (10% County match), through the SD Department of Corrections. All members present voting aye. Motion carried.
ABERDEEN AREA FOUNDATION REORGANIZATION:
Moved by Wiese, seconded by Sutton to acknowledge Restated Articles of Incorporation of Aberdeen Area Foundation, Inc., changing the name to Aberdeen Area Community Foundation Inc, and management to a Board of Trustees with Brown County no longer an active management participant. All members present voting aye. Motion carried.
CAR RACE TRACK DISCUSSION:
The Commission and Jamie Naasz, Brown County Speedway Lessee discussed multiple areas at the Fairgrounds that have not been cleaned and/or returned to usable condition since the last racing weekend; also payments to the county from Mr. Naasz. The Commission requested Mr. Naasz pay all bills and complete all cleanup issues by Monday, November 9.
BCCHC REPORT:
DeAnna Kyburz presented the Brown County Community Health Center Report for July – September 2009
INFECTIOUS DISEASE DISCUSSION:
Scott Meints, Marcy Fritz and Tom Schmitt presented a draft infectious disease policy. After discussion it was decided to condense the information and place in a memo for distribution.
CERT GUIDELINES:
Moved by Wiese, seconded by Sutton to approve amendments to the Community Emergency Response Team (CERT) Guidelines August 2009 Revision B (copy available for public inspection 8:00 a.m. – 5:00 p.m., Monday – Friday at Emergency Management Department or Auditor’s Office). All members present voting aye. Motion carried.
CERT EQUIPMENT:
Scott Meints and Tom Schmitt discussed the need for the CERT Program to purchase a four-wheeler at estimated cost of $11,350.00. Board concurred if funding available.
CPR TRAINING:
Members from the Safety Committee discussed the possibility of securing CPR training for employees. Marcy Fritz, Jail/JDC Nurse suggested that having key personnel as certified instructors would save the County training expenses in the future. Board concurred and agreed the commission budget would cover the cost for employee instructor certification and in house training materials.
COUNTY 23 BRIDGE 051:
Mark Peterson, SDDOT and Jan Weismantel, Highway Superintendent presented progress report on Bridge 051 on Brown County Road 23.
BRIDGE #278:
Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign Utilities Certificate and Right-of-Way Certificate for Bridge #278, BRO 8007 (37). All members present voting aye. Motion carried.
APPROACH APPLICATION PERMIT:
Moved by Wiese, seconded by Sutton to approve amended Application for Permit to Construct Access Approach form, as submitted by Jan Weismantel, effective November 3, 2009. All members present voting aye. Motion carried.
APPLICATION FOR OCCUPANCY REVISION:
Moved by Sutton, seconded by Wiese to approve amended Application for Occupancy Brown County Right-of-way form, as submitted by Jan Weismantel, effective November 3, 2009. All members present voting aye. Motion carried.
HIGHWAY EQUIPMENT:
Jan Weismantel requested permission to purchase a reconditioned 6” water pump from General Irrigation for $13,500.00. Board concurred.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Wiese to go into executive session for personnel discussion with Larry Gerlach in attendance. All members present voting aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a result of the discussion.
CLOSE OUT DOCUMENTS:
Ted Dickey, NECOG presented close out documents for the Health and Fitness Center Funding Project.
RECESS:
The Chairman declared the Commission recessed until November 10, 2009.
