Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioner’s
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Elliott, Sutton and Wiese. Brown County Government Day, sponsored by The
American Legion was held with 65 area high school students visiting the
Commission and all County Offices.

Moved by Wiese, seconded by Hansen to approve the Brown County Notice of Privacy
Practices for protected health information and related release forms. All
members present voting aye. Motion carried.
NEC TOWER LEASE:
Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign
agreement with Northern Electric Cooperative for lease of building and tower
space on the NEC tower near Bath for the Brown County Emergency Management radio
repeater at a rental rate of $100.00 per month. All members present voting aye.

SHERIFF REPORTS:
Moved by Wiese, seconded by Elliott to approve the following October 2009
Sheriff Reports: Incident and offenses; Prisoner care, JDC, Money deposited with
the County Treasurer and Monthly activities. All members present voting aye.
Motion carried.
2010 ASSESSMENT PLAN:
Moved by Hansen, seconded by Sutton to approve the 2010 Assessment Plan as
developed by Mary Worlie, Director of Equalization. All members present voting
aye. Motion carried.
2010 RACE TRACK LEASE:
Moved by Wiese, seconded by Hansen to revoke Jamie Naasz agreement to lease
Brown County facilities at the Fairgrounds for the 2010 Car Racing season, due
to breach of contract in regard to keeping in good standing with WISSOTA; and
further set date to open, read and consider sealed proposals to lease Brown
County facilities at the Fairgrounds for the 2010 Car Racing season, to be
opened at 9:15 a.m. December 8, 2009 in the Commissioner’s Chambers, Courthouse
Annex, Brown County, SD. All members present voting aye. Motion carried.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Wiese to go into executive session to discuss
personnel with Jan Weismantel in attendance. All members present voting aye.
Motion carried.
The Chairman declared the executive session closed, with no action taken as a
result of the discussion.

Moved by Sutton, seconded by Hansen to go into executive session to discuss
possible litigation with Mary Worley in attendance. All members present voting
aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a
result of the discussion.
APPOINT BROWN COUNTY CORONER:
Moved by Sutton, seconded by Hansen to appoint Michael Carlsen, as Brown County
Coroner, effective November 17, 2009. All members present voting aye. Motion
carried.
RECESS:
The Chairman declared the Commission recessed until November 24, 2009.
