The Brown County Commission convened at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Sutton and Wiese. Absent Commissioners Elliott and Fischbach.

Moved by Wiese, seconded by Sutton to appoint Nancy Hansen as Chairman in the absence of Tom Fischbach. All members present voting aye. Motion carried.

WEED & PEST GRANT APPLICATION:

Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign FY2011 Grant Application with the SD Weed and Pest Control Commission for grant funding on a 50/50 cost share basis for chemical, promotional items, radio ads and seasonal labor, effective July 1, 2010 to June 1, 2011. LANDFILL EXPANSION PROJECT:

Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign Change Order #2 for the Brown County Landfill Expansion Project, increasing total $11,045.00 for total contract price of $2,351,173.93. All members present voting aye. Motion carried.

Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign Payment Request #14 in amount of $117,860.44 for the Landfill Expansion Project. All members present voting aye. Motion carried.

12W/385th AVE INTERSECTION PROJECT:

Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign Change Order #2 in amount of $234.40 (decrease total to $201,442.00) for the Highway 12W/385th Ave Intersection Project. All members present voting aye. Motion carried.

Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign Payment Request #2 (final) in amount of $25,586.70 for the Highway 12W/385th Ave Intersection Project. All members present voting aye. Motion carried.

AGRONOMY EDUCATOR:

Marj Zastrow introduced Ronald Dodds as the newly hired Agronomy Educator for the Extension Service.

TOW TRUCK DISCUSSION:

John McQuillen, accompanied by several representatives of the tow truck providers for Brown County recommended that the charter members of the association determine the guidelines, renewal standards and approval for new members in the association. Board concurred.

PROPERTY TRANSFER:

Moved by Wiese, seconded by Sutton to approve the transfer of Decal #600 SN 297891 1982 Homemade Utility Trailer from the Weed Department to the Highway Department. All members present voting aye. Motion carried.

SNOW/ICE REMOVAL POLICY:

Moved by Sutton, seconded by Wiese to approve amending the Brown County Highway Department Snow/Ice Removal Procedures by adding section about stalled or stranded vehicles and mailbox damage. All members present voting aye. Motion carried.

EXECUTIVE SESSION:

Moved by Sutton, seconded by Wiese to go into executive session for personnel discussion with Kim Dorsett, Jan Weismantel and Jeanette Nietert in attendance. All members present voting aye. Motion carried.

The Chairman declared the executive session closed, with no action taken as a result of the discussion.

STATES ATTORNEY OFFICE SECURITY:

Kim Dorsett, States Attorney informed the Commission that the States Attorney’s Office entrance should have a security system similar to the Clerk of Courts Office. Board concurred.

RECESS:

The Chairman declared the Commission recessed until November 17, 2009.
