Meeting called to order by Chairman Fischbach at 9:30 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD.  Present were Commissioners Hansen, Sutton and Wiese.  Absent Commissioner Elliott.

EMPLOYEE FUNDED VISION CARE INSURANCE:
Moved by Hansen, seconded by Sutton to approve employee funded vision care insurance as a payroll deduction with a company to be determined at a later date.  All members present voting aye.  Motion carried.
LANDFILL EXPANSION FENCE PROJECT:
Moved by Sutton, seconded by Wiese to approve and authorize the Chairman sign Notice of Award for the Landfill Expansion Fence Project with American Fence Company; and further approve and authorize the Chairman sign Contract Agreement with American Fence Company for the project when prepared.  All members present voting aye.  Motion carried.
APPLICATION FOR OCCUPANCY:
Moved by Hansen, seconded by Sutton to approve and authorize the Chairman sign application, submitted by Qwest for occupancy of Brown County Highway #6 in Sec 25-T124N-R65W, Brown County, SD to provide telephone service.  All members present voting aye.  Motion carried.
BID – HIGHWAY 12W INTERSECTION PROJECT:
Moved by Hansen, seconded by Wiese to authorize advertising public hearing to open, read and consider bids for the Highway 12W Intersection Project, to be held in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD at 8:45 a.m. on June 16, 2009.  All members present voting aye.  Motion carried.
PLAT:
Commissioner Wiese offered the following Resolution:
RESOLUTION #33-09
BE IT RESOLVED by the County Commission of Brown County, SD, that the plat showing “Craig Lot A in SE ¼ SW ¼ Sec 18-T125N-R60W of the 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.
Seconded by Commissioner Sutton.  Roll call vote: Commissioners Hansen-aye, Elliott-absent, Sutton-aye, Wiese-aye, Fischbach-aye.  Resolution adopted.
SALARY SURVEY:
Tom Schmitt discussed a salary survey to be completed by county departments and agreed to serve as the point of contact.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Wiese to go into executive session to discuss litigation with Kim Dorsett and Mary Worlie in attendance.  All members present voting aye.  Motion carried.
The Chairman declared the executive session closed with no action taken as a result of the discussion.
LETTER OF ENGAGEMENT:
Moved by Hansen, seconded by Sutton to authorize a letter of engagement for professional fees be executed with Mike Amo to perform a real estate appraisal.  All members present voting aye.  Motion carried.

The Chairman declared the Commission recessed until June 2, 2009.
