Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioners
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Elliott, Sutton and Wiese.

Moved by Wiese, seconded by Sutton to approve the General Meeting minutes of May
12, 2009. All members present voting aye. Motion carried.

Moved by Sutton, seconded by Wiese to approve employee status change for Ben
Hofer from Highway Labor Grade 3 to Labor Grade 4, effective May 18, 2009 at
$14.32 per hour. All members present voting aye. Motion carried.
LEASE AGREEMENT:
Moved by Sutton, seconded by Wiese to approve agreement submitted by Jim River
Riders for lease of the Open Arena on Jun 14, July 12, August 9 and Sept 13,
2009. All members present voting aye. Motion carried.
TOWNSHIP BONDS:
Moved by Elliott, seconded by Sutton to approve the following Township Bonds
(clerk/treasurer): West Rondell #59 Larry Ihde, Al Ryckman. All members present
voting aye. Motion carried.
TAX DEED SALE:
Moved by Sutton, seconded by Elliott to approve and authorize the Chairman sign
Quit Claim Deeds to the successful bidders for the following Tax Deed property
sold at public auction on May 18, 2009: Oneota Township: OL 1 Barnard Elevator
NE 14-126-64, Brown County, SD @ $450.00; Shelby Township: S ½ of Lt 3 Blk 3
Houghton, Brown County SD @ $49.50; E 14’ of N 62’ Lt 26 and the N 62’ of Lt 27
Blk 3 Houghton, Brown County SD @ $112.50; Westport Town: Lt 6 Blk 9 Westport,
Warner City, Brown County, SD @ $675.00. All members present voting aye. Motion
carried.
DOC CONTRACT:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign
contract with the SD Department of Corrections for housing juveniles under the
jurisdiction of the State at the Brown County Juvenile Detention Center,
effective June 1, 2009 through May 31, 2010. All members present voting aye.
Motion carried.
SURPLUS SALE REPORT:
Moved by Sutton, seconded by Elliott to accept surplus sale report and
acknowledge proceeds in amount of $37,586.00. All members present voting aye.
Motion carried.
SDDOT WEED CONTROL CONTRACT:
Moved by Wiese, seconded by Elliott to approve and authorize the Chairman sign
Form DOT-209 in conjunction with the SD DOT Noxious Weed Control Agreement. All
members present voting aye. Motion carried.
PEDDLERS LICENSE:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign
Peddlers License #01-09 with Robert Steelman DBA Coast 2 Coast Equipment. All
members present voting aye. Motion carried.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Hansen to go into executive session to discuss
possible litigation with Kim Dorsett, Sheila Enderson and Mary Worlie in
attendance. All members present voting aye. Motion carried.
The Chairman declared the executive session closed with no action taken as a
result of the discussion.
JAIL TRUSTEES AND 24/7 PROGRAM:
Craig Nelson, Dean Marske, Duane Sutton and Mike Wiese presented committee
report on options for housing work release and 24/7 programs off-site. No action
was taken at this time.
BID AWARD – ROAD OIL MC-3000 AND MC-70:
Moved by Elliott, seconded by Hansen to award bid, submitted by Flint Hills
Resources, LP for furnishing and delivery of Road Oil MC-3000 @ $554.28 per ton
and Road Oil MC-70 @ $634.28 per ton, as bid by McPherson County on May 5, 2009
(only bid submitted). All members present voting aye. Motion carried.
CAGE FIGHTING EVENT:
Jason Ehresmann discussed the possibility of holding a Cage Fighting Event at
the Fairgrounds in June. No action was taken at the time.
MOTOR GRADER BID DISCUSSED:
Mike Sheehan and Casey Kamm, Sheehan Mack Sales & Equipment presented historical
and new information about various bids and the types of equipment on the market.
FAIRGROUNDS LIGHTING PROJECT:
Kurt Smith, Fairgrounds Manager and John Aman, Fair Board Member discussed an
anticipated lighting project for parking lots at an estimated cost of $60,000 –
$65,000 plus $12,000 for power. No action was taken at this time.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Wiese to go into executive session for personnel
discussion with Maxine Taylor in attendance. All members present voting aye.
Motion carried.
The Chairman declared the executive session closed, with no action taken as a
result of the discussion.
RECESS:
The Chairman declared the Commission recessed until May 26, 2009.
