Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Elliott, Sutton and Wiese.

PERSONNEL:
Moved by Elliott, seconded by Hansen to approve hiring Jeffrey McTague, Landfill Labor Grade 4, effective March 23, 2009 @ $12.55 per hour; and Todd Larson part-time Landfill Operator, effective March 23, 2009 @ $12.08 per hour. All members present voting aye. Motion carried.

Moved by Wiese, seconded by Hansen to approve hiring Stanley Schulz and Linn Kamin as full time Corrections Officers for the Jail, effective March 23, 2009 @ $12.52 per hour. All members present voting aye. Motion carried.

Moved by Hansen, seconded by Wiese to approve employee status change for Ross Erickson from Corrections Officer to Sheriff Field Deputy at $15.84 per hour, effective April 6, 2009 until Nathan Smith returns from active duty, when Ross will return to Corrections Officer position. All members present voting aye. Motion carried.

Moved by Wiese, seconded by Hansen to approve hiring Dennis Ells as part-time Fairgrounds employee, effective March 30, 2009 at $8.82 per hour. All members present voting aye. Motion carried.

RICHMOND YOUTH CAMP HAY CUTTING OPTION:
Moved by Hansen, seconded by Elliott to accept renewal option for 2009, submitted by Frohling Farms for purpose of hay cutting at the Richmond Youth Camp (approximately 21 acres @ $27.50 per acre) in amount of $577.50. All members present voting aye. Motion carried.

SHERIFF REPORTS:
Moved by Hansen, seconded by Sutton to approve the following February 2009 Sheriff Reports: Incidents and offenses, Prisoner care, JDC, Money deposited with the County Treasurer and Monthly activities. All members present voting aye. Motion carried.

JOINT POWERS AGREEMENT:
Moved by Sutton, seconded by Hansen to approve and authorize the Chairman sign Joint Powers Agreement with Groton School District 6-6 for purpose of delegating the joint exercise of administering the bonded indebtedness of the former Groton School District 6-3. The parties find that Groton School District 6-6 is in the best position to administer the outstanding indebtedness of the former district. Nothing contained in the Joint Powers Agreement shall be construed to authorize the transfer of liabilities of the former district to the County or Groton School District 6-6. All members present voting aye. Motion carried.

WELFARE DEPARTMENT ANNUAL REPORT:
Moved by Sutton, seconded by Wiese to accept for filing the 2008 Welfare Department Annual Report, submitted by Charlene Millim, Welfare Director.

MOTOR CROSS CLUB:
Corey Harder, representing the Motor Cross Club explained that a portion of the property currently used by the Club is no longer available and the Club is looking for options. The Commission suggested exploring grant funding sources.

FAIRGROUNDS CAMPGROUND PROPOSAL:
John Aman, Kurt Smith and Larry Gerlach appeared to present a proposal from the Brown County Fair with the cooperation of the Brown County Fairgrounds requesting a campground expansion of 270 full service sites with further expansion of 68 sites to be located on land east of existing Fairgrounds. This proposal is follow-up to an earlier discussion with additional cost estimates. No action was taken at this time.

BID – HAY CUTTING EAST OF FAIRGROUNDS:
Time and place, as advertised to open, read and consider proposals for hay cutting on county owned land east of the Fairgrounds. Moved by Sutton, seconded by Hansen to award cash rent proposal for hay cutting on county owned land east of the Fairgrounds, submitted by Alan Neitzel in amount of $63.50 per acre (approximately 40 acres); rejecting Stu Swenson @ $51.39 per acre. All members present votion aye. Motion carried.

BID AWARD EXTENSION – TIRES:
Moved by Wiese, seconded by Sutton to approve bid award extension on State Bid Contract #15255 for tires for the Highway Department, effective through March 1, 2010. All members present voting aye. Motion carried.

BOX AND HOIST QUOTES:
Moved by Wiese, seconded by Sutton to accept low quote, submitted by Safety Service Inc in amount of $22,750.00 for Box and Hoist for new tandem truck; rejecting Northern Truck @ $23,242.00, Sanitation Products @ $24,978.25. All members present voting aye. Motion carried.

SURPLUS SALE SET - AUCTIONEER QUOTES:
Moved by Sutton, seconded by Wiese to authorize Brown County Surplus Sale be held at the Brown County Highway Department on May 8, 2009; and further to accept quote from Buntrock Auction Service @ $385.00 for advertising and 3.5% of gross sales or $400.00, whichever is greater; rejecting quotes submitted by Thorpe Auction Service, Inc @ $1,000.00 for advertising and 4% of gross sales or $700.00, whichever is greater; and Jark/Worlie Auction Service @ $2,000.00 flat fee. All members present voting aye. Motion carried.

JANITORIAL SERVICE QUOTES:
Moved by Hansen, seconded by Elliott to accept low quote, submitted by Bakken Building Maintenance @ 500.00 per month, effective March 18, 2009 for janitorial services at the Highway Department; rejecting VanMeter Facility Maintenance @ $625.00 per month. All members present voting aye. Motion carried.

HIGHWAY UPDATE:
Jan Weismantel, Highway Superintendent discussed the consequences if Bridge 172 is taken off the STIP Plan and discussed status of Bridge 204.

CENTENNIAL VILLAGE ANNUAL REPORT:
Don Gisi presented the 2008 Centennial Village Annual Report.

GIS ORDINANCE:
Scott Madsen, GIS Coordinator and Kim Dorsett, States Attorney discussed preliminary draft of GIS Ordinance. No action was taken at this time.

NESDCAP:
Toby Morris, Northland Securities and two representatives from NESDCAP discussed Workforce Housing Project proposed for Aberdeen and the possible tax breaks that would be available. Two options may be available depending upon qualifications (tax exempt status or discretionary formula).

NORTHERN BEEF PACKERS:
Allen Dunlavy, Northern Beef packers requested weight limits be lifted on the portion of Brown County #10 from Hub City Livestock south to 135th Street. Moved by Sutton, seconded by Wiese to amend the following section of the Belt Loop around Aberdeen (minutes of March 3, 2009), which is excluded from the posted 6-tons per axle and 40 MPH for trucks during the March/April spring thaw and breakup or until roads become stable: County Road #19 (Melgaard Road) south 1.0 miles to County Road #14W. All members present voting aye. Motion carried.

COMMISSION WORKSHOP UPDATE:
Commissioner Elliott presented an update on the Commission Workshop held in Pierre.
