JUNE 16, 2009 GENERAL MEETING

Meeting called to order by Chairman Fischbach at 8:45 a.m. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Elliott, Sutton and Wiese.

MINUTES:
Moved by Hansen, seconded by Wiese to approve the General Meeting minutes of June 9, 2009. All members present voting aye. Motion carried.

PERSONNEL:
Moved by Wiese, seconded by Sutton to approve hiring Clay Nelson as part-time JDC Corrections Officer, effective June 23, 2009 at $10.48 per hour. All members present voting aye. Motion carried.

SHERIFF REPORTS:
Moved by Hansen, seconded by Elliott to approve the following May 2009 Sheriff Reports: Incident and offenses; Prisoner care, JDC, Money deposited with the County Treasurer and Monthly activities. All members present voting aye. Motion carried.

PROPERTY TRANSFER:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign agreement with the following entities that received equipment from the 2004 ODP Equipment Grant Program: Barb Paepke (weather radio), Richmond Youth Camp (weather radios); 2007 HLS Equipment Grant Program: Aberdeen Fire & Rescue (mobile data terminals), Brown County Sheriff (mobile data terminals); 2008 HLS Equipment Grant Program: Aberdeen Rural Fire Protection District (extendaire kit), Aberdeen Fire & Rescue (cascade systems), Aberdeen Police Department (mobile data terminals). All members present voting aye. Motion carried.

FAIR BOARD AGREEMENT:
Moved by Wiese, seconded by Sutton to approve and authorize Larry Gerlach to sign agreement with Romeo Entertainment Group to provide e-mail list management and marketing services for the Brown County Fair in amount not to exceed $2,000.00. All members present voting aye. Motion carried.

GRANT LETTER OF AGREEMENT:
Moved by Wiese, seconded by Sutton to approve and authorize Larry Gerlach to sign FY 2010 Letter of Agreement for the Governor’s Million Dollar Challenge grant award for the 2009 Brown County Fair marketing plan in amount of $30,780 (county share $15,390, state share $15,390). All members present voting aye. Motion carried.

LANDFILL AGREEMENT:
Moved by Wiese, seconded by Elliott to approve and authorize the Chairman to sign agreement with Northern Electric Cooperative, Inc. for labor and materials for power supply installation to the Brown County Landfill Expansion Project (Unit 2) at estimated cost of $29,150.00. All members present voting aye. Motion carried.

FIREWORKS PERMIT:
Moved by Sutton, seconded by Hansen to approve and authorize the Chairman sign Fireworks Public Display Permit, submitted by Kent Larson, Richmond Lake Association 379799 N Shore Drive, Aberdeen, SD for a fireworks display to be held on July 4, 2009 at Richmond Lake. All members present voting aye. Motion carried.

BID 12W CONCRETE INTERSECTION PROJECT:
Time and place, as advertised to open, read and consider bids to furnish all labor, material and equipment necessary to complete all the work for the 12W/385th Ave Intersection Project. Bids were received from Upper Plains Contracting, Inc; Lien Transportation & Construction; B&B Contracting, Inc. Moved by Wiese, seconded by Sutton to refer all bids to Jan Weismantel, Highway Superintendent and Helms & Associates for review and recommendation. All members present voting aye. Motion carried. Moved by Hansen, seconded by Sutton to award low bid, submitted by B&B Contracting, Inc in amount of $196,093.40; rejecting Upper Plains Contracting in amount of $224,679.70, Lien Transportation & Construction in amount of $249,444.18. All members present voting aye. Motion carried. Moved by Wiese, seconded by Hansen to authorize the Chairman sign Notice of Award to B&B Contracting for 12W/385th Ave Intersection Project in amount of $196,093.40. All members present voting aye. Motion carried.

BRIDGE #051:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman to sign Change Order #2 for Bridge #051 relocating structure four feet to the west. All members present voting aye. Motion carried.

AGREEMENT BRIDGE #031:
Moved by Wiese, seconded by Elliott to approve and authorize the Chairman sign Right-of-Way Agreement with Staubach Global, BNSF Railroad in conjunction with Bridge #031 Project located south of Aberdeen on County Road 10, effective until January 1, 2010. All members present voting aye. Motion carried.

HIGHWAY ANNUAL REPORT:
Jan Weismantel, Highway Superintendent presented the 2008 Annual Report for the Brown County Highway Department.

2010 GLACIAL LAKES BUDGET:
Rosie Smith, Executive Director Glacial Lakes & Prairies presented program statistics and related information in regard to the 2010 Glacial Lakes budget request.

OWNER/OCCUPIED STATUS DISCUSSED:
John Davidson requested consideration for owner/occupied status on the home he purchased in the spring of 2008. The home was unoccupied on the assessment date of November 1, 2007, therefore does not qualify for owner/occupied status for taxes payable in 2009. With regret the Commission denied the request for consideration for owner/occupied status on the home.

2010 GIS BUDGET:
Scott Madsen, GIS Coordinator presented information in regard to the 2010 budget request for GIS activities.

COUNTY LAND DISCUSSION:
Steve Stickelmyer discussed the possibility of purchasing county owned land adjacent to the commercial property he owns at 1011 1st Ave SE. There was no action taken by the Commission at this time.

CREDIT CARD DISCUSSION:
Scott Meints and Bill Meink discussed need for a county credit card. There was no action taken by the Commission at this time.

RECESS:
The Chairman declared the Commission recessed until June 23, 2009.
