Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioners Chambers, Courthouse Annex, Brown County, South Dakota. Present were Commissioners Hansen, Elliott, Sutton and Wiese.

AWARD MOTOR GRADER BID - AMEND:
Moved by Sutton, seconded by Elliott to amend motion to award motor grader in minutes dated May 12, 2009 by striking all reference to a five year lease, as Custer County’s bid proposal did not allow for a lease arrangement only requested an outright purchase; therefore, award bid, as submitted by Butler Machinery at the Custer County Bid Letting held April 22, 2009 for one 2009 Caterpiller Model 140M All Wheel Drive Motor Grader in amount of $208,800.00 plus options listed in Custer County Bid for total amount of $234,642.00. Roll call vote: Commissioners Hansen-aye, Elliott-aye, Sutton-aye, Wiese-aye, Fischbach-nay. Motion carried.
SPECIAL MALT BEVERAGE LICENSE HEARING:

LANDFILL EXPANSION PROJECT:
Moved by Sutton, seconded by Elliott to approve and authorize the Chairman sign Payment Request #7 in amount of $240,595.55 for the Brown County Landfill Expansion Project. All members present voting aye. Motion carried.
Moved by Sutton, seconded by Hansen to approve and authorize the Chairman sign Change Order #1 for the Brown County Landfill Expansion Project, decreasing total $4,800.00 for total contract price of $2,340,128.93. All members present voting aye. Motion carried.
HIGHWAY 12W INTERSECTION PROJECT:
Moved by Hansen, seconded by Wiese to approve and authorize the Chairman sign Contract Agreement and Notice to Proceed with B & B Contracting Inc. for completion of the Highway 12W Intersection Project. All members present voting aye. Motion carried.
SHERIFF REPORTS:
Moved by Sutton, seconded by Elliott to approve the following June 2009 Sheriff Reports: Incident and offenses; Prisoner care, JDC, Money deposited with the County Treasurer and Monthly activities. All members present voting aye. Motion carried.
INTEREST STATEMENT:
Moved by Sutton, seconded by Elliott to accept for filing the April - June 2009 Interest Statement, submitted by County Treasurer Sheila Enderson. All members present voting aye. Motion carried.
ORDINANCE #060:
Moved by Hansen, seconded by Sutton to approve Second Reading and Adoption of Ordinance #060, An Ordinance amending Second Revision Brown County Ordinances, Title 4, Chapter 4.3501 Communication Towers and Facilities Requirements, Subsection F. Submittal Requirements, by adding 15. The applicant shall agree, in writing, to allow for possible co-location of Brown County Public Safety equipment in the top position to the proposed communications facility and grants a perpetual access agreement to such equipment. Brown County Communications Department would be responsible for all public safety equipment installed. Roll call vote: Commissioners Hansen-aye, Elliott-aye, Sutton-aye, Wiese-aye, Fischbach-aye. Ordinance adopted.
CLOSING AUDIT CONFERENCE:
Kay Fredrick, Department of Legislative Audits met with the Commission for closing conference for audit of fiscal year 2008.
TEEN COURT 2010 BUDGET:
Rick Hansen and Bonnie Siebrecht, Teen Court Program presented statistics and program information in regard to the 2010 Teen Court Budget request.
INDIGENT COUNSEL AGREEMENT – AMENDED:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign amendment to the 2008-2009 Indigent Counsel Agreement, as amended. All members present voting aye. Motion carried.
COURTHOUSE ANNEX WINDOW PROJECT – BID ADDENDUM #1:
Moved by Hansen, seconded by Elliott to approve Addendum #1 - Item #1 Change bid opening date to August 4, 2009 at 9:00 a.m.; Item #2 Alternate bid proposal for triple glazed insulating glass for the Courthouse Annex Window Project (to be funded in part by DOE Grant). All members present voting aye. Motion carried.
APPLICATION FOR OCCUPANCY:
Moved by Sutton, seconded by Hansen to approve and authorize the Chairman sign application, submitted by Northern Electric for occupancy of Brown County Highway #14E in NE Sec 22-T123N-R63W, Brown County, SD to provide electrical service. All members present voting aye. Motion carried.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Wiese to go into executive session for personnel discussion with Jan Weismantel in attendance. All members present voting aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a result of the discussion.
RECESS:
The Chairman declared the Commission recessed until July 28, 2009.
