Moved by Wiese, seconded by Sutton to approve hiring the following to perform security work during the 2009 Brown County Fair, effective August 17, 2008 at $16.00 per hour: Jon Waldner, Vance McInerney, Troy Strid, Kyle Stoddard, Brook Brown, Mark Miller, Mike Bunke, Nick Cochrane, Darin Moke, Justin Meyer, Mike Waldrop and Justin Cleveland. LANDFILL EXPANSION PROJECT:

Moved by Hanson, seconded by Wiese to approve and authorize the Chairman sign Payment Request #9 in amount of $42,788.80 for the Brown County Landfill Expansion Project. All members present voting aye. Motion carried.

SHERIFF REPORTS:

Moved by Wiese, seconded by Sutton to approve the following July 2009 Sheriff Reports: Incident and offenses; Prisoner care, JDC, Money deposited with the County Treasurer and Monthly activities. All members present voting aye. Motion carried.

FIREWORKS PERMIT:

Moved by Elliott, seconded by Wiese to approve and authorize the Chairman sign Fireworks Public Display Permit, submitted by Larry Gerlach, Brown County Fair for a Class B Fireworks Display to be held on August 22, 2009 in the infield of the racetrack at the Fairgrounds. All members present voting aye. Motion carried.

AGREEMENT:

Moved by Wiese, seconded by Sutton to approve and authorize the Chairman sign End User Agreement, which allows the Brown County Director of Equalization limited right to use Marshall & Swift Proprietary Information in DEVNET, Inc CAMA (Computer Aided Mass Appraisal) Program. All members present voting aye. Motion carried.

BID – LANDFILL WETLANDS SEEDING PROJECT:

Moved by Hansen, seconded by Wiese to authorize advertising public hearing to open, read and consider sealed bids for the Landfill Wetlands Seeding Project, to be held in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD on September 8, 2009 at 8:45 A.M. All members present voting aye. Motion carried.

GIS FORMS AND FEE STRUCTURE:

Commissioner Sutton offered the following Resolution:

RESOLUTION #50-09

WHEREAS, Title 19, Second Revision Brown County Ordinance, as amended, requires the Brown County Commission, by resolution, to set approve all forms and set fees necessary for the implementation of the Geographic Information Systems (GIS) Data Access and Distribution Ordinance, and

WHEREAS, Brown County GIS Forms and Fee Structure has been submitted for adoption by the Brown county Commission in regular session this 18th day of August 2009.

NOW, THEREFORE BE IT RESOLVED that the Brown County Commission adopt Brown County GIS Forms and Fee Structure, necessary for the implementation of the Geographic Information Systems (GIS) Data Access and Distribution Ordinance.

Seconded by Commissioner Elliott. Roll call vote: Commissioners Hansen-aye, Elliott-aye, Sutton-aye, Wiese-aye, Fischbach-aye. Resolution adopted.

WEED POSITION DISCUSSED:

Roger Johnson, Weed Supervisor discussed options of full-time or part-time employment. No action was taken at this time.

BANK DISCUSSION:

Sheila Enderson, Brown County Treasurer discussed new banking issues, which will affect Brown County investments and daily balances. No action was taken as a result of the discussion.

DETERMINATION OF RIGHT-OF-WAY EASEMENT:

Moved by Wiese, seconded by Sutton to acknowledge receipt of application, submitted by Prairie Hill Farms LLC for determination of a right-of-way or easement in accordance with SDCL 31-22-2; and further to schedule a meeting at the land located in the NW ¼ of Sec 15-T124N-R62W of the 5th P.M., Brown County, SD for 11:00 a.m., Tuesday August 25, 2009 to make a determination whether a right-of-way should be granted to Prairie Hill Farms, LLC from landowners Dean Weismantel and Donald Weismantel. All members present voting aye. Motion carried.

EXECUTIVE SESSION:

Moved by Sutton, seconded by Wiese to go into executive session for personnel discussion with Kim Dorsett and Jeanette Nietert in attendance. All members present voting aye. Motion carried.

The Chairman declared the executive session closed, with no action taken as a result of the discussion.

BID – 12W PROJECT:

Moved by Wiese, seconded by Fischbach to authorize Vice-Chairman Nancy Hansen sign Notice of Award to Lien Transportation Company for completion of the Brown County 12W Reconstruction Project. All members present voting aye. Motion carried.

RECESS:

The Chairman declared the Commission recessed until August 25, 2009.
