Meeting called to order by Chairman Fischbach at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Elliott, Sutton and Wiese. Absent Commissioner Hansen.

Moved by Wiese, seconded by Sutton to approve the April 7, 2009 General Meeting Minutes. All members present voting aye. Motion carried.

Moved by Sutton, seconded by Wiese to approve the following employee step increases, effective April 19, 2009: Roxy Hilgenberg @ $12.36 per hour, David Fair @ $19.15 per hour, Diane Mielke @ $14.93 per hour, Bryan Owens @ $12.90 per hour, Kathy Fischer @ $18.09 per hour. All members present voting aye. Motion carried.

Moved by Wiese, seconded by Sutton to acknowledge the following miles driven and amount to be taxed for personal use of County vehicles during the months of January – March 2009: Jan Weismantel – 244.8 @ $134.64, Markcus Selzler – 391 @ $215.05, Kendell Titze – 354 @ $194.70, Michael Scott – 520 @ $286.00. All members present voting aye. Motion carried.

Moved by Wiese, seconded by Sutton to approve employee status change for Timothy Harford from part-time to regular part-time, effective April 5, 2009 at $10.48 per hour. All members present voting aye. Motion carried.

INTEREST STATEMENT:
Moved by Sutton, seconded by Elliott to accept for filing the January - March 2009 Interest Statement, submitted by County Treasurer Sheila Enderson. All members present voting aye. Motion carried.

MALT BEVERAGE LICENSE TRANSFER APPLICATION:
Moved by Elliott, seconded by Wiese to authorize advertising public hearing to consider the following malt beverage license application: Transfer Retail (on-off sale) Malt Liquor License from Al Malsam DBA A&E Promotions to Jamie Naasz DBA Brown County Speedway – Brown County Fairgrounds (Grandstand) SW ¼-Sec 1-T123N-R64W (map indicating specific building on file with application), to be held in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD at 9:30 A.M. May 5, 2009. All members present voting aye. Motion carried.

SPECIAL MALT BEVERAGE HEARING:
Moved by Wiese, seconded by Sutton to authorize advertising a public hearing to be held in the Commissioners Chambers, Courthouse Annex, Brown County, SD on May 5, 2009 at 9:30 a.m. to consider the following applications for Special Malt Beverage Licenses: Northeast Area Horse Racing, Inc., P.O. Box 1104, Aberdeen, S.D. 57401 at the Brown County Fairgrounds SW ¼ Sec 1-T123N-R64W (maps indicating specific building on file with application): Clubhouse effective May 9, 10, 16 & 17, 2009; Grandstand effective May 9, 10, 16 & 17, 2009; Clubhouse effective May 23, 24 & 25, 2009: Grandstand effective May 23, 24 & 25, 2009. WEED & PEST GRANT APPLICATION:
Moved by Wiese, seconded by Sutton to approve and authorize Roger Johnson to submit online Grant Application to the SD Department of Health for the 2009 Mosquito Prevention and Control Program. All members present voting aye. Motion carried.

BID OPENING – TANDEM TRUCK:
Time and place, as advertised to open, read and consider bids for Tandem Axle Semi Tractor for the Highway Department. Bids were opened from Crawford Trucks, Sheehan Mack Sales, Wallwork Trucks. Moved by Wiese, seconded by Sutton to refer all bids to Jan Weismantel, Highway Superintendent for review and recommendation. All members present voting aye. Motion carried.

FUEL BID AWARD:
Moved by Wiese, seconded by Sutton to award the following Fuel Bids from state bid contracts, effective April 1, 2009 through March 31, 2010 inclusive, as follows: Contract #15618 Howes Oil Company, Inc for Transport Gasohol and Transport Diesel (all types); Contract #15629 North Central Farmers Elevator for Tankwagon Diesel (all types). All members present voting aye. Motion carried.

APPLICATION FOR TEMPORARY OCCUPANCY:
Moved by Wiese, seconded by Sutton to approve and authorize the Chairman to sign the following application, submitted by Brown County to The Burlington Northern and Santa Fe Railway Company for occupancy of the SW ¼ Sec 36-T123N-R64W for a temporary easement for construction of a replacement bridge on County Highway 10, located just upstream from the Railroad Bridge. This is necessary for placement of riprap in the County right-of-way. All members present voting aye. Motion carried.

BID RESCIND/AWARD – ASPHALT ROLLER:
Moved by Sutton, seconded by Elliott to rescind portion of motion in minutes of February 17, 2009 awarding bid, submitted by RDO Equipment Company for a 2009 Sakai Double Drum Asphalt Roller with trade in amount of $31,500.00 less $2,100.00 for net cost of $29,400.00, as this machine failed to meet specifications when delivered; and further to award second low bid, submitted by Diesel Machinery Inc for a 2009 Hypac Double Drum Asphalt Roller with trade in amount of $37,500.00 less $5,000.00 for net cost of $32,500.00. All members present voting aye. Motion carried.

BID OPENING – BELLY PUP TRAILER:
Time and place, as advertised to open, read and consider bids for Belly Pup Trailer for the Highway Department. Bids were opened from Diesel Machinery Inc, JD Evans, Sheehan Mack Sales, Wallwork Trucks. Moved by Sutton, seconded by Elliott to refer all bids to Jan Weismantel, Highway Superintendent for review and recommendation. All members present voting aye. Motion carried.
