PLAT:
Commissioner Elliott offered the following Resolution:
RESOLUTION: #48-09
Be it Resolved by the County Commission of Brown County, SD, that the plat showing “Newman Consolidation Subdivision in NE ¼ Sec 4-T123N-R64W of 5th P.M., Brown County, SD”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.
Seconded by Commissioner Sutton. Roll call vote: Commissioners Hansen-aye, Elliott-aye, Sutton-aye, Wiese-absent, Fischbach-aye. Resolution adopted.
WAIVE FEES – FALL CLEANUP:
Moved by Sutton, seconded by Elliott to approve waiving fees during the Fall Residential Cleanup Event for all materials received at the Landfill ONLY from September 4 thru 12, 2009. Charges will apply to all mobile homes, business and commercial waste during this time frame. All members present voting aye. Motion carried.
LANDFILL EXPANSION PROJECT:
Moved by Hanson, seconded by Sutton to approve and authorize the Chairman sign Payment Request #8 in amount of $162,225.31 for the Brown County Landfill Expansion Project. All members present voting aye. Motion carried.
LOTTERY APPLICATIONS:

SDPAA NOMINATION:
Commissioner Sutton offered the following Resolution:
RESOLUTION #49-09
WHEREAS, several positions on the South Dakota Public Assurance Alliance Board of Directors are up for election, and
WHEREAS, Brown County Commissioner Mike Wiese is currently serving as Vice Chairman on the South Dakota Public Assurance Alliance Board of Directors and desires to continue.
BE IT RESOLVED that the Brown County Commission hereby nominates Mike Wiese for re-election to the SD Public Assurance Alliance Board of Directors on behalf of Brown County.

POD GRANT AGREEMENT:
Moved by Sutton, seconded by Elliott to approve and authorize the Chairman sign Grant Agreement with the State of SD for federal financial assistance to develop local POD (Point of Distribution) plans, effective August 1, 2009 thru May 31, 2010 in amount of $15, 250.00. All members present voting aye. Motion carried.
BID - 12W RECONSTRUCTION PROJECT:
Moved by Hansen, seconded by Sutton to approve and authorize the Chairman sign Addendum #1 – Section 00300 Bid Form, base bid – grading and asphalt surfacing, items 10 & 11 on the specifications for the 12W Reconstruction Project. All members present voting aye. Motion carried.
Time and place, as advertised to open, read and consider bids for the 12W Reconstruction Project. One bid received from Lien Transportation Company. Moved by Elliott, seconded by Sutton to refer the bid to Jan Weismantel, Highway Superintendent and Jay Koch, Helms and Associates for review and recommendation. All members present voting aye. Motion carried.
BID – COURTHOUSE ANNEX WINDOW PROJECT:
Time and place, as advertised to open, read and consider bids for the Courthouse Annex Window Project. One bid received from House of Glass, Inc. Moved by Sutton, seconded by Hansen to award bid, submitted by House of Glass Inc in total amount of $45,300.00 (only bid received) for labor and material to complete Courthouse Annex Window Project (to be funded by DOE stimulus funds). All members present voting aye. Motion carried.

HIGHWAY UPDATE:
Kendell Titze, Highway Foreman presented informational report.
BCCHC REPORT:
DeAnna Kyburz presented the Brown County Community Health Center Report for April – June 2009.
EXECUTIVE SESSION:
Moved by Sutton, seconded by Elliott to go into executive session to discuss possible litigation with Kim Dorsett and Mary Worlie in attendance. All members present voting aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a result of the discussion.
BUDGET WORK SESSION:
The Commission continued review of the 2010 budget requests. There was no action taken at this time.
RECESS:
The Chairman declared the Commission recessed until August 11, 2009.
