MARCH 18, 2008 – GENERAL MEETING
Meeting called to order by Chairman Wiese at 8:45 a.m. in the Commissioner’s
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Feickert and Knecht. Absent Commissioner Fischbach.

Moved by Hansen, seconded by Feickert to approve the General Meeting minutes of

MALT BEVERAGE LICENSE TRANSFER APPLICATION:
Moved by Hansen, seconded by Feickert to authorize advertising public hearing to
consider the following malt beverage license application: Transfer Retail
(on-off sale) Malt Liquor License from Terry Voeltz, DBA T’s Promotions to Al
Malsam DBA A&E Promotions Brown County Speedway – Brown County Fairgrounds
(Grandstand) SW ¼-Sec 1-T123N-R64W (map indicating specific building on file
with application), to be held in the Commissioner’s Chambers, Courthouse Annex,
Brown County, SD at 9:00 A.M. April 8, 2008. All members present voting aye.
Motion carried.
WELFARE GUIDELINES AMENDED:
Commissioner Knecht offered the following Resolution:
RESOLUTION NO. 24-08
WHEREAS, Title 2, Second Revision of Brown County Ordinances, as amended,
requires the Brown County Commission, by resolution, to adopt rules, regulations
and appendixes necessary for the implementation of a County Welfare Program, in
accordance with SDCL 28-13; and
WHEREAS, the Brown County Commission adopted the Brown County Welfare Guidelines
by Resolution No. 4-98, dated January 6th 1998; amended by Resolution No. 2-06,
dated April 4, 2006, and
WHEREAS, it is deemed necessary and in the best interest of the residents of
Brown County to amend Appendix A Income Eligibility/Determination Tests –
Poverty Guidelines.
NOW, THEREFORE BE IT RESOLVED that Appendix A Income Eligibility/Determination
Tests – Poverty Guidelines be amended as follows:

Commissioner Hansen offered the following Resolution:
RESOLUTION NO. 25-08
WHEREAS, Title 2, Second Revision of Brown County Ordinances, as amended,
requires the Brown County Commission, by resolution, to adopt rules, regulations
and appendixes necessary for the implementation of a County Welfare Program, in
accordance with SDCL 28-13; and
WHEREAS, the Brown County Commission adopted the Brown County Welfare Guidelines
by Resolution No. 4-98, dated January 6th 1998; amended by Resolution No. 2-06,
dated April 4, 2006, and
WHEREAS, it is deemed necessary and in the best interest of the residents of
Brown County to amend Appendix B Housing Assistance.

The maximum rental supplement per household per month shall not exceed the
following, including utilities:
1 Person Household $240 (monthly rent)
2 Person Household $260 (monthly rent)
3 Person Household $280 (monthly rent)
4 Person Household $300 (monthly rent)

ORDINANCE NO. 051:
Moved by Hansen, seconded by Feickert to approve Second Reading and Adoption of
Ordinance No. 051, An Ordinance amending Second Revision Brown County Ordinances
to rezone the following described property from its present zoning designation
of Chapter 4.06 Agriculture Preservation District (AG-P) to Chapter 4.10 Lake
Front Residential District (R-3): Lots 1-3 First Subdivision of Bauer’s Outlot,
Lots 5-9 First Subdivision of Bauer’s Outlot, Lots 1-6 Second Subdivision of
Bauer’s Outlot and Lot 3 of Bauer’s Third Addition in the SW ¼ of Sec
7-T123N-R65W of the 5th P.M., Brown County, SD. Roll call vote: Commissioners
Hansen-aye, Fischbach-absent, Feickert-aye, Knecht-aye, Wiese-aye. Ordinance
adopted.
EXECUTIVE SESSION:
Moved by Feickert, seconded by Knecht to go into executive session for personnel
discussion. All members present voting aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a
result of the discussion.
CHEMICAL BIDS:
Time and place, as advertised to open, read and consider bids for furnishing and
delivery of chemical for the Brown County Weed and Pest Board for 2008. One bid
was received from VanDiest Supply Company, Pierre, SD. Moved by Feickert,
seconded by Knecht to refer bid to Brown County Weed and Pest Supervisor for
tabulation and recommendation. All members present voting aye. Motion carried.
SPEED LIMIT DISCUSSION:
Al Waltman met with the Commission to discuss the speed limit across the
spillway at Richmond Lake Dam. There was no action taken by the Commission at
this time.
EXECUTIVE SESSION:
Moved by Hansen, seconded by Feickert to go into executive session for contract
discussion with Mick Palmer and Richard Burns in attendance. All members present
voting aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a
result of the discussion.
COURTHOUSE PARKING LOT:
Mick Palmer and Richard Burns discussed bid options for completion of the
Courthouse Parking Lot Project. The Commission authorized Mick Palmer to proceed
with the bid process.
RENTAL OF EQUIPMENT BID AWARD:
Moved by Feickert, seconded by Hansen to award the following bids for Rental of
Equipment: Dump Trucks to Fred Ludwig Trucking, 16.5 ton @ $64.95 per hour (fuel
over $3.50 per gallon and haul over 14 miles add $2.00 per hour); Semi Trailer
to Odland Construction, 28 ton @ $80.00 per hour; Semi Tractor/Trailer with Pup
Trailer to Odland Construction, 40 ton @ $95.00 per hour; Side Dumps to H F
Jacobs & Son Construction, 25 ton @ $90.00 per hour; Dozer to H F Jacobs & Son
Construction, Cat D8R @ $90.00 per hour; Paving Equipment to Aberdeen Asphalt @

AUCTIONEER QUOTES:
Moved by Hansen, seconded by Knecht to accept quote from Buntrock Auction
Service for Brown County Surplus Sale @ $3% of gross sales or $250.00, whichever
is greater; rejecting quotes submitted by Thorpe Auction Service, Inc @ 4% of
gross sales or $600, whichever is greater; and Jark/Worlie Auction Service @
$1,000.00 plus sales tax and advertising. All members present voting aye. Motion
carried.
BID AWARD – ROAD OIL MC-3000:
Moved by Knecht, seconded by Hansen to award bid, submitted by Flint Hills
Resources, LP for furnishing and delivery of Road Oil MC-3000 @ $448.51 per ton,
as bid by Edmunds County on February 19, 2008; rejecting bid submitted by Jebro
Inc @ $477.60 per ton. All members present voting aye. Motion carried.
BID AWARD – ROAD OIL MC-70:
Moved by Hansen, seconded by Feickert to award bid, submitted by Flint Hills
Resources, LP for furnishing and delivery of Road Oil MC-70 @ $548.85 per ton,
as bid by Day County on March 4, 2008; rejecting bid submitted by Jebro Inc @
$575.00 per ton. All members present voting aye. Motion carried.
RECESS:
Chairman Wiese declared the Commission recessed from 10:00 a.m. to 10:30 a.m.,
at which time the Commission reconvened with Commissioners Wiese, Hansen,
Feickert and Knecht present.
ORDINANCE NO. 052:
Moved by Feickert, seconded by Hansen to set hearing date for Brown County
Ordinance No. 052, An Ordinance amending Second Revision Brown County
Ordinances, Title 4, Chapter 4.1918 subsection 1. by deleting the following
sentence “Properties that have received a Letter of Map Amendment or Letter of
Map Revision based upon fill must still have their lowest floor elevated to one
foot above the base flood elevation”, to be held in the Commissioner’s Chambers,
Courthouse Annex, Brown County, SD at 8:45 a.m. on April 8, 2008. All members
present voting aye. Motion carried.
FAIRGROUNDS ROAD CONSTRUCTION PROJECT:
Aberdeen City Engineer Robin Bobzien and Mayor Mike Levsen presented preliminary
engineering plans for the Fairgrounds Road 2008 Construction Project, beginning
at the intersection of Brown County 10 and Fairgrounds Road, extending east
approximately one-half mile. Anticipated bid date for project is April 9, 2008,
with initial completion date of August 9, 2008. Permanent and temporary
easements will be presented at a later date for review and execution between
Brown County and the City for the Project.
LANDFILL SPRING RESIDENTIAL CLEANUP:
Moved by Hansen, seconded by Knecht to approve waiving fees on all material
types from Residential Users Only during the Spring Residential Cleanup at the
Brown County Landfill, to be held from April 25 thru May 31, 2008. No free waste
will be accepted from Commercial Contractors or Businesses (including mobile
homes). In the event circumstances beyond the control of Brown County (flood,
tornado, fire, other) would occur during the FREE Cleanup period the Brown
County Commission would reserve the right to end the free cleanup period at such
time and implement the regular fee structure. All members present voting aye.

The Chairman declared the executive session closed, with the following action
taken as a result of the discussion.
Moved by Feickert, seconded by Hansen to appoint Janet Weismantel as Brown
County Highway Superintendent, at an annual pro-rated salary of $51,501.00,
effective April 21, 2008 – April 20, 2010 (per SDCL 31-11-1 two year term). All
members present voting aye. Motion carried.
