MARCH 11, 2008 – GENERAL MEETING
Meeting called to order by Chairman Wiese at 8:45 A.M. in the Commissioner’s Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen, Fischbach and Feickert. Absent Commissioner Knecht.

Moved by Hansen, seconded by Feickert to approve the General Meeting minutes of March 4, 2008. All members present voting aye. Motion carried.

All members present voting aye. Motion carried.
AUDITORS REPORT OF ACCOUNT:
Moved by Hansen, seconded by Feickert approve the January 2008 Auditor’s Report of Account with the County Treasurer in total amount of $11,462,393.54 (total amount of actual cash @ $3,087.76, Wells Fargo Bank @ $3,694.79, US Bank @ $286,258.26, Dacotah Bank @ $84,288.60, Petty Cash @ $1,800.00, Fund Investments @ $11,082,851.89, Outstanding Checks @ $412.24). All members present voting aye. Motion carried.

Moved by Hansen, seconded by Feickert to approve the February 2008 Auditor’s Report of Account with the County Treasurer in total amount of $11,248,916.26 (total amount of actual cash @ $3,334.16, Wells Fargo Bank @ $3,694.79, US Bank @ $58,320.30, Dacotah Bank @ $27,940.67, Petty Cash @ $1,800.00, Fund Investments @ $11,153,660.50, Outstanding Checks @ $165.84). All members present voting aye. Motion carried.
LOTTERY APPLICATION:
Moved by Feickert, seconded by Fischbach to approve the application submitted by Granary Memorial Gallery, Inc., for raffle to be held on June 15 and July 6, 2008. All members present voting aye. Motion carried.
EQUALIZATION NOTICES:
Moved by Fischbach, seconded by Feickert to authorize publishing notices for the Brown County Board of Equalization and the Consolidated Board of Equalization. All members present voting aye. Motion carried.
WELFARE DEPARTMENT ANNUAL REPORT:
Moved by Hansen, seconded by Feickert to accept for filing the 2007 Welfare Department Annual Report, submitted by Charlene Millim, Welfare Director.
SURPLUS PROPERTY:
Moved by Feickert, seconded by Hansen to declare miscellaneous salvageable material surplus for sale from the Dacotah Prairie Museum (i.e. scrap tin, brass, copper). All members present voting aye. Motion carried.
BID – RENTAL OF EQUIPMENT:
Time and place, as advertised to open, read and consider bids for furnishing Full Operation Rental Services of Gravel Trucks and Road Machinery for construction and maintenance repairs on Brown County Road Projects for year 2008. Bids were received from Aberdeen Asphalt, Inc, Aberdeen; Lien Transportation, Aberdeen; HF Jacobs & Son Construction, Aberdeen; Slaight Construction, Hecla; Kevin Bourdon, Aberdeen; Hanlon Brothers, Verdon; Howell Trucking, Aberdeen; Herb Dabbert Trucking, Aberdeen; Hollaway Construction, Mitchell; Odland Construction & Gravel, Redfield; David Gardner Trucking, Mina; Fred Ludwig Trucking, Aberdeen; Upper Plains Contracting, Aberdeen. Moved by Fischbach, seconded by Feickert to refer all bids to Richard Burns, Interim Highway Superintendent for tabulation, review and recommendation. All members present voting aye. Motion carried.
STRIPING AGREEMENT:
Moved by Feickert, seconded by Hansen to approve and authorize the Chairman to sign agreement with the SD DOT for the striping of county roads within Brown County and provide for their continuing maintenance. All members present voting aye. Motion carried.
ORDINANCE NO. 051 – FIRST READING:
Time and place, as advertised for First Reading of Ordinance No. 051. No one appeared with testimony, comments and/or questions for discussion. Moved by Hansen, seconded by Fischbach to approve First Reading of Ordinance No. 051, An Ordinance amending Second Revision Brown County Ordinances to rezone the following described property from its present zoning designation of Chapter 4.06 Agriculture Preservation District (AG-P) to Chapter 4.10 Lake Front Residential District (R-3): Lots 1-3 First Subdivision of Bauer’s Outlot, Lots 5-9 First Subdivision of Bauer’s Outlot, Lots 1-6 Second Subdivision of Bauer’s Outlot and Lot 3 of Bauer’s Third Addition in the SW ¼ of Sec 7-T123N-R65W of the 5th P.M., Brown County, SD. All members present voting aye. Motion carried.
COURTHOUSE PARKING LOT:
Mick Palmer, Maintenance Supervisor discussed resurfacing the Courthouse parking lot. The Commission requested it be bid with options of an asphalt surface or a concrete surface.
PHASE II JAIL PROJECT:
Mick Palmer and Dean Marske informed Commission that most of the clean-up/touch-up work was complete on the Phase II Jail Project, the garage floor will be painted this week and the correct elevator track has been ordered.
RACE TRACK ADDENDUM NO. 1:
Moved by Fischbach, seconded by Feickert to approve and authorize the Chairman to sign First Addendum to lease agreement for the Brown County Raceway with Al Malsam DBA A&E Promotions, to allow the following racing events: Monster Truck Event on July 26, 2008 and World of Outlaws Late Model Division on July 18, 2008, with balance and remainder of lease agreement remaining unchanged and in full force and effect. All members present voting aye. Motion carried.
EXECUTIVE SESSION:
Moved by Fischbach, seconded by Feickert to go into executive session for personnel discussion. All members present voting aye. Motion carried.
The Chairman declared the executive session closed, with no action taken as a result of the discussion.
RECESS:
The Chairman declared the Commission recessed until March 18, 2008.
