APRIL 1, 1008 – GENERAL MEETING
The Brown County Commission convened at 8:45 a.m. in the Commissioner’s
Chambers, Courthouse Annex, Brown County, SD. Present were Commissioners Hansen,
Fischbach, Feickert, Knecht and Wiese.
MINUTES:
Moved by Hansen, seconded by Feickert to approve the Joint City/County Meeting
minutes of March 24, 2008 and the General Meeting minutes of March 25, 2008. All
members present voting aye. Motion carried.

Moved by Feickert, seconded by Knecht to approve the following employee step
increases, effective April 6, 2008: Jo Forsting @ $13.04 per hour, Geri Sillman
@ $14.24 per hour, David Fair @ $18.37 per hour, Jeff Kirnan @ $14.93 per hour,
Judy Dosch @ $17.24 per hour, Jon Koeniguer @ $12.64 per hour. All members
present voting aye. Motion carried.
Moved by Feickert, seconded by Fischbach to approve hiring the following
part-time employees at the Sheriff Department for 24/7 Sobriety Program: Cheryl
Grant, effective March 30, 2008 and Molly Peterson, Shirelle Stadel, Diane
Brist, Robert Baumgartner, Dennis “Mike” Olson, and Kari Brandlee, effective
March 24, 2008 at $10.07 per hour. All members present voting aye. Motion
carried.
Moved by Feickert, seconded by Knecht to approve hiring Dennis Ells part-time at
the Fairgrounds, effective March 31, 2008 at $8.48 per hour. All members present
voting aye. Motion carried.
LANDMARK COMMISSION:
Moved by Feickert, seconded by Knecht to accept for filing the 2007 Landmarks
Commission Annual Report. All members present voting aye. Motion carried.
LEASE AGREEMENT:
Moved by Knecht, seconded by Feickert to approve and authorize the Chairman sign
agreement with Northeast Area Horse Racing, Inc. for lease of various
Fairgrounds facilities from April 1, 2008 through May 29, 2008. All members
present voting aye. Motion carried.
SDDOT WEED CONTROL CONTRACT:
Moved by Feickert, seconded by Knecht to approve and authorize the Chairman sign
agreement with the SD DOT for the County to furnish the necessary equipment,
material and labor to control the growth of declared noxious weeds within the
right-of-way of state routes as designated in agreement, effective May 1, 2008 –
October 15, 2008. All members present voting aye. Motion carried.
PLANNING & ZONING DISCUSSION:
Heidi Martilla Losure met to appeal the denial of building permit by the
Planning and Zoning Board for a second residence on a farm site. After
discussion the following action was taken. Moved by Knecht, seconded by Hansen
to overturn the Planning and Zoning Board decision to deny building permit and
recommended that the application be approved at the next meeting. All members
present voting aye. Motion carried.
ATTORNEY GENERAL OPINION:
Kim Dorsett, States Attorney discussed inquiry from Dennis Feickert about
requesting an Attorney General Opinion in regard to SDCL 11-9-42, which states
no tax increments shall be used for the construction of residential structures.
It was the general consensus of the Commission that the States Attorney requests
an official opinion from the Office of the Attorney General.
PHASE II JAIL PROJECT – CHANGE ORDER:
Moved by Feickert, seconded by Fischbach to approve and authorize the Chairman
to sign the following Change Orders for Phase II Jail Project: #7 increasing
total cost by $3,823.55; #7 decreasing total cost by $840.82; and #9 increasing
total cost by $8,669.92, bringing total project cost to $1,502,773.85. All
members present voting aye. Motion carried.
COURTHOUSE PARKING LOT PROJECT:
Lonnie Anderson, Mick Palmer, Richard Burns and Jan Weismantel met to discuss
Courthouse Parking Lot Project timeline. Moved by Knecht, seconded by Feickert
to set date to open, read and consider sealed bids to complete the Courthouse
Parking Lot Project for 9:15 a.m. on April 29, 2008 in the Commissioners
Chambers, Courthouse Annex, Brown County, SD. All members present voting aye.
Motion carried.
TAX DEED PROPERTY DISCUSSED:
Erling Podoll met to discuss a lot in Westport that his deceased father had an
one/eighth interest in and questioned why all eight names aren’t on the tax
records. It was explained that when a property has multiple owners the first
name listed on the deed is used followed by et al (and others). Once all tax
deed proceedings are complete, Brown County will become the property owner.
SAFETY COMMITTEE:
Lisa Samson, Judy Dosch and Tom Schmitt met with the Commission to discuss the
importance of and procedure for presenting safety education classes to
employees. The Commission deemed the classes important and encouraged all
department heads to have their employees participate. Classes will be offered in
one or more of the following forms: classroom, video, on-line.
JAMES RIVER BANK PROJECT DECISION:
The County will not participate in the project of rip-rapping the James River
bank adjacent to the property owned by Robert Pray, as requested by Darrel
Raschke, James River Water Development District, Randy Stanley and Robert Pray,
due to cost estimates and liability issues.
APPLICATION FOR OCCUPANCY:
Moved by Knecht, seconded by Feickert to approve and authorize the Chairman sign
application, submitted by WEB Water Development for occupancy of Brown County
Highway #10 in Sec 13-T126N-R64W of the 5th P.M., Brown County, SD, to install a
potable water line. All members present voting aye. Motion carried.
HOUGHTON PROPERTY DISCUSSION:
Sheila Enderson and Kim Dorsett discussed nuisance complaint received on a
property in Houghton. The States Attorney will contact owner and present options
for resolving the problem.
EQUALIZATION:
Mary Worlie met to present preliminary information about the equalization
process that begins next week.
RECESS:
The Chairman declared the Commission recessed until April 8, 2008.
